Terms of Service
A legally binding agreement between Welcoming Web Limited and you.

Introduction
These Terms of Service ("Terms") constitute a legally binding agreement between Welcoming Web Limited, a company registered in England and Wales under company number 16933487 ("Welcoming Web", "we", "us", or "our"), and the entity or individual accessing or using the Services ("Customer", "you", or "your"). These Terms govern your access to and use of Welcoming Web's accessibility enhancement software, including its widget, automated scanning tools, monitoring features, dashboards, and related services (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.
Nature of the Services
The Services provide automated accessibility enhancement tools designed to assist website operators in improving usability and accessibility features for end users.
The Services are technological tools only and do not constitute legal advice, regulatory advice, or certification services.
The Services:
- Do not guarantee compliance with any law, regulation, or accessibility standard, including but not limited to the Equality Act 2010, WCAG (any version), the Americans with Disabilities Act (ADA), or similar legislation;
- Do not certify or warrant that any website is fully accessible or compliant;
- May not detect, identify, or remediate all accessibility issues.
You acknowledge that achieving full legal or regulatory accessibility compliance typically requires manual auditing, human review, and ongoing governance processes beyond automated tools.
Licence Grant
Subject to your compliance with these Terms and payment of applicable fees, Welcoming Web grants you a limited, non-exclusive, non-transferable, revocable licence to install and use the Services on the domain(s) specified in your subscription.
Each licence applies only to the website(s) for which it was purchased unless otherwise agreed in writing.
You may not:
- Reverse engineer, decompile, or disassemble the Services;
- Copy, distribute, sublicense, resell, or commercially exploit the Services;
- Modify or create derivative works of the Services;
- Use the Services in any unlawful manner.
Customer Responsibilities
You remain solely responsible for:
- The content and operation of your website;
- Compliance with applicable accessibility laws and regulations;
- Reviewing and implementing any recommendations generated by the Services;
- Ensuring that subsequent website changes do not undermine accessibility improvements.
Automated scanning results and reports are indicative only and may not reflect all accessibility issues.
You acknowledge that failure to implement recommended remediation steps may affect accessibility outcomes.
Automated and AI-Based Features
Certain features of the Services may rely on automated systems or artificial intelligence.
Automated outputs may contain inaccuracies, omissions, or unintended results.
You are responsible for reviewing and verifying any automated changes, reports, or remediation suggestions before relying upon them.
No Legal Advice
Welcoming Web is not a law firm and does not provide legal advice.
Nothing within the Services or in any communication from Welcoming Web shall be interpreted as legal advice or as a legal opinion regarding compliance with any law or standard.
Fees and Payment
Fees are payable in accordance with your selected subscription plan.
Subscriptions renew automatically at the end of each billing cycle unless cancelled prior to renewal.
We may suspend or terminate access to the Services for non-payment.
All fees are exclusive of VAT and any applicable taxes unless otherwise stated.
Suspension and Termination
We may suspend or terminate your access to the Services if:
- You breach these Terms;
- Payment is overdue;
- Your use presents legal, security, or operational risk.
You may cancel your subscription in accordance with your subscription terms. Unless required by law, fees paid are non-refundable.
Intellectual Property
All intellectual property rights in and to the Services remain the exclusive property of Welcoming Web or its licensors.
Nothing in these Terms transfers ownership of the Services to you.
Disclaimer of Warranties
The Services are provided "as is" and "as available".
To the fullest extent permitted by law, Welcoming Web makes no warranties, whether express or implied, including any warranties of:
- Merchantability;
- Fitness for a particular purpose;
- Non-infringement;
- Regulatory compliance.
Limitation of Liability
Nothing in these Terms excludes or limits liability for:
- Death or personal injury caused by negligence;
- Fraud or fraudulent misrepresentation;
- Any liability that cannot be excluded under applicable law.
Subject to clause 11.1, Welcoming Web shall not be liable for:
- Indirect, incidental, special, or consequential loss;
- Loss of profits, revenue, goodwill, business opportunity, or data;
- Regulatory fines or penalties;
- Claims arising from your website's non-compliance with accessibility laws;
- Any third-party claims relating to your website.
Welcoming Web's total aggregate liability arising under or in connection with the Services shall not exceed the total fees paid by you in the six (6) months preceding the event giving rise to the claim.
Indemnity
You agree to indemnify and hold harmless Welcoming Web from and against any third-party claims, liabilities, damages, losses, and expenses arising out of:
- Your website content;
- Your breach of these Terms;
- Your failure to implement accessibility recommendations;
- Your violation of applicable law.
Data Protection
We process personal data in accordance with our Privacy Policy.
Where Welcoming Web processes personal data on your behalf, the applicable Data Processing Addendum shall apply.
Changes to These Terms
We may update these Terms from time to time.
Continued use of the Services after updates take effect constitutes acceptance of the revised Terms.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction over any dispute arising from these Terms.
